These Terms & Conditions govern applications to and participation in the FOMO 2027 Get Involved Program(“Program”), organized by MODERN BUSINESS OWNERS S.R.L., with registered office at 57-59 Ion Ionescu de la Brad Boulevard, District 1, Bucharest, Romania, registration number J2024029255005, VAT number 50668775(“FOMO”, “we”, “us”).
By submitting an application to the Program, you confirm that you have read and understood read, understood and accept these Terms & Conditions, and you agree to be bound by them.
FOMO 2027 Get Involved is built around a simple idea: talented people deserve more opportunities to be seen for what they can do.
Through the Program, FOMO aims to discover and promote talent, facilitate opportunities for people’s work to be seen, and support freelancers, creators, entrepreneurs, independent professionals and small businesses by giving them opportunities to contribute, create, connect and showcase what they do.
We invite participants to bring their skills, ideas, experience, perspective, communities and creativity into the making of FOMO 2027.
Depending on the selected role, this may include contributing to an existing project, creating content or materials, representing FOMO within a community, supporting the production of the festival, learning alongside the team, or developing and taking ownership of a specific project.
Our goal is not only to create a better FOMO through these contributions, but also to make the people behind the work more visible — giving participants opportunities for recognition, attribution and exposure to the FOMO community and wider ecosystem.
Participation may take forms including:
Submitting an application does not guarantee selection or participation in the Program.
FOMO is a curated project, and participants, ideas and proposed contributions are selected according to the strategy, creative direction, operational needs and objectives of FOMO 2027.
When reviewing applications, FOMO may take into account factors including:
FOMO may choose not to select an application even where the applicant has relevant experience or strong work if the proposed contribution does not fit the current strategy, creative direction, operational needs or available opportunities of FOMO 2027.
Selection is based on fit with the Program and should not be understood as a judgment of an applicant’s overall talent, professional ability or value.
Where appropriate, FOMO may request additional information, examples of previous work, a portfolio, an interview or an informal discussion before making a selection decision.
FOMO reserves the right to select the participants, projects, proposals and contributions that it considers suitable for the Program, subject to applicable law and without discrimination on prohibited grounds.
If you are selected, FOMO will communicate the proposed role, project, responsibilities, expected involvement, timing and any other relevant conditions.
Selection through the application process does not necessarily mean that every idea, proposal or piece of work subsequently submitted by the participant will be produced or used by FOMO.
Projects may evolve during development, and FOMO may approve, reject, modify or discontinue proposals depending on strategy, quality, feasibility, timing, resources, legal requirements or production needs.
Where appropriate, specific projects may be subject to a separate written agreement.
The exact nature of participation will depend on the category and project.
Certain roles may require meetings, deadlines, collaboration with FOMO team members, access to internal information, on-site participation or delivery of specific materials.
Participants are expected to perform the responsibilities they have expressly agreed to take on and to communicate promptly if they are unable to fulfil them.
Participation in the Program does not automatically create an employment relationship, partnership, agency relationship or entitlement to future employment.
Where applicable law requires a particular contractual relationship, including an employment, internship or other regulated arrangement, the relevant agreement will be entered into separately.
Unless expressly agreed otherwise in writing, selection for the Contributor, Ambassador or Project collaboration categories does not automatically entitle the participant to salary, fees or other financial compensation.
Where a particular project is paid, reimbursed, sponsored or otherwise compensated, those terms will be agreed separately before the relevant activity begins.
Expenses will only be reimbursed where they have been expressly approved by FOMO in advance.
Any role offered as a formal internship or other legally regulated training or employment arrangement will be governed by the applicable legal requirements and a separate written agreement.
One of the objectives of the Program is to help talented people and businesses become more visible through meaningful work.
Depending on the nature of the contribution, FOMO may showcase or credit selected participants through channels such as:
The form, timing and extent of visibility or attribution will depend on the project and will be determined by FOMO.
Where appropriate, FOMO may identify the participant, their business, their role or their contribution when presenting the relevant work.
However, participation does not guarantee a particular level of exposure, audience reach, press coverage, social-media performance, commercial opportunity, employment opportunity, follower growth, customer acquisition or future collaboration.
FOMO wants participants to be recognized for their work while also being able to fully own, develop, publish, adapt and continue using the work that becomes part of FOMO.
Pre-existing work
Any intellectual property, materials, trademarks, methods, tools, know-how, portfolio work or other content created independently by a participant before joining the Program (“Pre-existing Materials”) remains the property of that participant.
Submitting an application, portfolio, proposal, concept or idea for consideration does not, by itself, transfer ownership of that material to FOMO.
Accepted Work
Where any work, material, content, design, copy, video, photography, concept, campaign, product, application, artwork, project output or other deliverable created or provided by a participant is:
that material will be referred to as the “Accepted Work.”
For Accepted Work, the participant agrees to assign to MODERN BUSINESS OWNERS S.R.L., on an exclusive basis, all transferable economic intellectual-property rights to the fullest extent permitted by applicable law.
The assignment is intended to allow FOMO to use the Accepted Work without limitation as to medium or commercial purpose and includes, where legally applicable, rights to:
Unless a specific written agreement states otherwise, the assignment will apply worldwide and for the entire legal duration of the relevant intellectual-property rights, including any extensions or renewals permitted by law.
Where applicable law requires rights, uses, remuneration, duration, territory or other elements of an intellectual-property assignment to be expressly described, such details may also be set out in a separate written project or intellectual-property agreement.
The participant agrees to sign any reasonable documentation required to confirm or perfect the transfer of rights in Accepted Work.
Under Romanian copyright rules, assignments of economic rights require specific treatment, while moral rights are treated differently and are not simply transferable in the same manner.
Moral rights
To the extent that moral rights or comparable personal rights cannot legally be assigned, they remain with the author.
To the fullest extent permitted by applicable law, the participant agrees not to exercise such rights in a manner that would unreasonably prevent FOMO from reproducing, publishing, editing, adapting, combining, distributing or otherwise using the Accepted Work in accordance with the agreed transfer of economic rights.
Attribution does not affect ownership
FOMO may credit or publicly recognize the participant as the creator or contributor to Accepted Work.
Such attribution does not alter or limit FOMO’s ownership of the transferred economic rights.
Pre-existing material incorporated into Accepted Work
If Accepted Work includes material previously owned by the participant, the participant must identify that material to FOMO before or at the time it is incorporated into the project.
Unless ownership of such Pre-existing Materials is separately transferred, the participant grants FOMO a worldwide, irrevocable, transferable and sublicensable licence for the entire legal term of protection to use those materials to the extent necessary to use, modify, distribute and exploit the Accepted Work.
Third-party rights
Participants must not knowingly submit or incorporate material that infringes the copyright, trademark, privacy, image, confidentiality or other rights of another person or business.
Where third-party material is used, the participant must inform FOMO and obtain any permissions required for the intended use.
FOMO wants participants to be able to show meaningful work they have helped create.
Unless otherwise agreed, and subject to confidentiality requirements, third-party rights and publication timing, participants may refer publicly to their involvement with FOMO and may include publicly released work they contributed to in their professional portfolio.
Participants may not publish confidential, unreleased or embargoed material without FOMO’s prior approval.
Where appropriate, FOMO may provide guidance regarding the way a participant’s role or contribution should be described publicly.
Participation in FOMO activities may involve photography, video or audio recording.
Where required by applicable law, appropriate consent or contractual permission will be obtained for FOMO’s use of a participant’s name, image, likeness or voice.
Specific image or recording permissions may be covered through a separate release or participation agreement.
Participants may receive access to confidential or non-public information, including:
Participants must not disclose or use confidential information outside the purposes of their collaboration with FOMO unless FOMO authorizes the disclosure or disclosure is required by law.
This obligation may continue after participation in the Program ends.
Participants are expected to work professionally and respectfully with the FOMO team, other contributors, speakers, attendees, partners and members of the community.
FOMO may end or suspend a participant’s involvement in cases including:
FOMO 2027 is a live project, and plans may change.
FOMO may change the scope, timeline, format, production requirements or direction of a project where reasonably necessary for creative, strategic, legal, operational, commercial, safety or production reasons.
FOMO may also decide not to produce, publish or use a proposed project or contribution.
Where a significant change materially affects a participant’s agreed role, FOMO will aim to communicate this as soon as reasonably practicable.
Participants may withdraw from the Program by informing their FOMO contact as early as reasonably possible.
FOMO may also end a participant’s involvement where:
Ending participation does not reverse any intellectual-property transfer that has already validly taken effect in relation to Accepted Work, unless a separate written agreement expressly provides otherwise.
Passes, accreditation, festival access, invitations, benefits, experiences or other perks vary depending on the participant’s role.
Participation does not automatically provide unrestricted access to all FOMO areas, backstage areas, sessions or related events.
Specific benefits will be communicated separately where applicable.
Participants attending FOMO venues or activities must comply with applicable venue regulations, health and safety rules, accreditation requirements and reasonable instructions from authorized FOMO or venue personnel.
Certain activities may require additional documentation, training or safety procedures.
Personal information submitted as part of the application process may be used for purposes including:

Where consent is legally required for a specific use of personal data, marketing communications, photography or other processing, it will be requested separately where appropriate.
Unless a particular Program opportunity expressly provides otherwise, applicants must be at least 18 years old.
Where participation by a person under 18 is permitted, FOMO may require parental or legal-guardian consent and any other documentation required by law.
The Program is intended to create opportunities for visibility, collaboration, experience and connection.
However, FOMO does not guarantee that participation will result in employment, clients, revenue, investment, business opportunities, media coverage, partnerships or any particular professional or commercial outcome.
Certain roles or projects may require a separate agreement dealing with matters including:
Where a separately signed agreement conflicts with these Terms, the specific agreement will govern that particular collaboration to the extent of the conflict.
FOMO may modify, suspend, postpone or cancel all or part of the Program where reasonably necessary due to operational, legal, commercial, production, safety, financial, force-majeure or event-related circumstances.
Where reasonably possible, affected participants will be informed.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
To the extent permitted by law, FOMO will not be liable solely because:
FOMO may update these Terms where reasonably necessary.
Any material changes affecting an already confirmed collaboration may also be communicated directly to the relevant participant where appropriate.
These Terms are governed by the laws of Romania, unless a separate written agreement provides otherwise.
Any disputes arising from or relating to these Terms will be subject to the jurisdiction of the competent Romanian courts, subject to any mandatory legal rules that provide otherwise.
